All references to Original Equipment Manufacturer (OEM) names, trademarks, part numbers, and machine models (including but not limited to Atlas Copco, Rammer, Epiroc, Montabert, Sandvik, Krupp, Furukawa, NPK and Okada) are utilized strictly for identification and cross-reference purposes.
Merit is an independent manufacturer of high-performance aftermarket components. We are not affiliated with, authorized by, endorsed by, or in any way officially connected to the aforementioned OEMs or any of their subsidiaries. All trademarks remain the sole property of their respective owners.
2. Engineering Standards and Operational Integrity
While Merit components are engineered to meet or exceed OEM-equivalent specifications for durability and precision, their performance is contingent upon professional handling.
- Operational Limits: Merit shall not be held responsible for diminished performance or structural failure resulting from improper installation, neglect, or use in applications exceeding the equipment’s design parameters.
- Maintenance: Failure to adhere to industry-standard service procedures for hydraulic breakers nullifies any claims regarding component reliability.
3. Verification of Suitability
Merit provides no warranties, express or implied, concerning the “fitness for a particular purpose” beyond standard hydraulic rock-breaking operations. It is the sole responsibility of the end-user or technician to verify the technical compatibility and fitness of any Merit part for their specific equipment configuration prior to installation.
4. Limitation of Liability
Under no circumstances shall Merit be liable for any indirect, incidental, or consequential damages. This includes, but is not limited to:
- Equipment downtime and operational delays.
- Loss of commercial profits or revenue.
- Labor costs associated with part replacement or machine repair.
5. OEM Warranty Impact
The installation of aftermarket components may influence or void existing warranties provided by the Original Equipment Manufacturer. Merit advises all customers to review their OEM warranty terms and conditions before integrating non-OEM parts into their fleet.
